1. Who we are
These terms apply to all work, bookings, quotes, invoices and courtesy cars from JLR Motorsport Ltd, trading as JLR Autocare, registered in England & Wales (company number 17001720), 29 Wilbury Way, Hitchin, Hertfordshire, SG4 0TW. By booking, leaving a vehicle with us, or authorising work, you accept these terms. We point them out when you book, and every booking confirmation text and every invoice links to them.
2. Your statutory rights
Nothing in these terms takes away your rights under the Consumer Rights Act 2015 or any other law that protects you. Where the law says we must do our work with reasonable care and skill, we do. We never limit our liability for death or personal injury caused by our negligence, or for fraud. If anything in these terms conflicts with your legal rights, your legal rights win and the rest of these terms still apply.
3. Bookings, estimates and authority
A booking made online, by phone or with Orla, our receptionist, is a request for a time. Any price given before we have seen the vehicle is an estimate. We will not go beyond the work and price you authorised without asking you first. If we find more work that is needed once the vehicle is stripped down, we will contact you with what we found, why it matters and the price. If you decline, we will stop, put the vehicle back together where it is safe to do so, and charge only for the authorised work and parts used up to that point. We record every authorisation and every refusal, with the date, time and how it was given (in person, by phone, by text or by link). That record forms part of your contract with us.
4. Parts
We fit only parts we have supplied ourselves. We do not fit parts supplied by customers.
5. Putting things right
Parts we supply and work we carry out are guaranteed for six months, unless a longer period is stated on your quote or invoice. This is on top of your legal rights, which always apply. If something goes wrong with work we did, tell us and we will look at it and put it right where we are responsible.
If we advised you in writing that another part needed replacing to protect the repair (for example a worn oil pump, a blocked diesel particulate filter, or a failing cooling part), explained the risk of leaving it, and you declined, then we are not responsible for failure or damage caused by that declined part. The declined item, the risk we explained and the date and time you declined are printed on your invoice. This does not remove our responsibility if the failure was caused by our own work.
If you think something is wrong with work we did, please contact us before anyone else works on the vehicle, so we can inspect it. If another garage repairs it first without asking us, we may not be able to confirm the cause, which can affect what we can put right.
6. Collection and storage charges
We will tell you by text, phone or email when your vehicle is ready to collect. If the vehicle is not collected within 24 hours of that message, a storage charge of £25 per day (including VAT) applies from then until it is collected. This charge covers the space and security the vehicle takes up. It does not apply while we are still working on the vehicle, while we are waiting for parts, or where the delay is our fault.
Vehicles that are still not collected are treated as uncollected goods under the Torts (Interference with Goods) Act 1977. We will write to you at your last known address, giving you reasonable notice to collect and pay. If you still do not collect, we may sell the vehicle and keep what you owe us (unpaid invoice and storage charges) from the sale price. Any money left over is held for you.
7. Payment and our right to keep the vehicle
Payment is due in full when you collect, unless we agreed otherwise in writing. All prices include VAT at the current rate unless stated. Until the invoice is paid, we have a right in law (a lien) to keep the vehicle, and storage charges under section 6 continue while it remains unpaid and uncollected.
8. Your vehicle and belongings while with us
Please remove valuables, cash, documents and personal items before handing the vehicle over. We are not responsible for loss of or damage to belongings left in the vehicle, or to the vehicle itself, unless it is caused by our negligence or by our breaking these terms. We are not responsible for loss or damage caused by events outside our control, for faults that already existed when the vehicle arrived, or for wear-related parts failing during testing or road tests where the part was already worn.
We will record the vehicle's condition and mileage when it comes in. If you think we caused damage, please tell us before you leave the premises, or as soon as you reasonably can, so we can look at it with you.
9. Parking your vehicle
When we have no space on our premises, we may park your vehicle legally on a public road or in another lawful parking place near the garage, locked and with the keys held by us. We are not responsible for loss or damage while it is parked this way unless it is caused by our negligence. We will not park it anywhere it would get a parking fine. If a fine is caused by how we parked it, we will pay it.
10. Road tests
You authorise our qualified staff to drive the vehicle on public roads to diagnose faults and check repairs. We are insured for this.
11. Courtesy cars
Courtesy cars are provided under a separate loan agreement you sign when you collect one. That agreement sets out insurance, driving licence checks, fuel, fines and damage. You cannot collect your own vehicle while a courtesy car is still out on loan to you.
12. Cancelling a booking
Please let us know as soon as you can if you need to cancel or move a booking. Where a deposit was taken for parts ordered specially for your vehicle, we may keep the cost of those parts if they cannot be returned. If you do not turn up to three bookings in a row, we may ask for a deposit before booking again.
13. Disputes
If you are unhappy, please tell us first so we can try to put it right. We keep a full record of every booking, call, text, authorisation, refusal, inspection and invoice for your vehicle, and we will use that record to resolve any complaint fairly. These terms are governed by the laws of England & Wales, and the courts of England & Wales have jurisdiction.
14. Our website
All website content, text, images and logos belong to JLR Motorsport Ltd or its licensors and may not be copied without our written consent. We take care to keep the website accurate, but prices and information on it are a guide until confirmed for your vehicle.
